Lottery Corporation - Demo Website We act as solicitors for Western Canada Lottery Corporation ("WCLC"). WCLC, a non-profit organization, was incorporated without share capital under Part II of the Canada Corporations Act on May 13, 1974. The provincial Governments of Manitoba, Saskatchewan and Alberta are members of the WCLC, and the Yukon Territory, Northwest Territories and Nunavut participate with the Provinces as associate members in the sale of lottery tickets. Under the terms of it's incorporation, WCLC is responsible for the conduct and management of lottery games in Western Canada. In connection with it's conduct and management of lottery games, WCLC is an owner and/or authorized user of several official marks, including, without limitation, LOTTO 6/49, PICK 3, PROLINE, LOTTO SUPER 7 and EXTRA. We have been advised by our client that the demo website which you prepared for WCLC in 1999 in response to RFP #309-99 has been cached at and is accessible through your website www.ravis.org. In addition, it has come to our client's attention that your cached version of the demo website has achieved a prominent ranking on at least one internet search engine. |

We acknowledge your disclaimer on the cached website that is it not the "real" site, however, notwithstanding the disclaimer, your caching of the website and providing access to others via the internet is an infringement of WCLC's and its licensor's trade-marks and other property rights. We hereby request, on behalf of our client, that you immediately cease and desist the use in any manner of the demo website and that you take appropriate steps to arrange for the removal of the demo website from your cache at accessible through www.ravis.org and to remove all references and links to the demo website from www.ravis.org. If you do not cease and desist from such use as requested, our client will, without further notice, seek whatever remedies are available to it at law, including, without limitation, damages and injunctive relief and obtaining an order for the removal of the demo website from your website, together with compensation for all legal costs incurred in obtaining its remedies. As you can appreciate, this is an important matter and we urge you to deal with it accordingly in order to avoid the consequences and costs of the steps our client is prepared to take in order to protect its interest.
